1- المقدمة: تعد هذه الشروط والأحكام الإطار القانوني الذي ينظم استخدامك لمنصة (Gig) المملوكة من قبل جيج ماركت بليس للخدمات الالكترونية والمدارة من قبل جيج ماركت بليس للخدمات الالكترونية.

1- Introduction: These terms and conditions form the legal framework that governs your use of the (Gig) platform, owned by Gig Marketplace for Electronic Services and managed by Gig Marketplace for Electronic Services.

باستخدامك للمنصة أو قيامك بأي خدمة من خلالها فإنك تقر بقراءتك لهذه الشروط وفهمها وموافقتك الكاملة عليها والإقرار بقواعد المنصة بما في ذلك الحضور والتقييمات والسلوك الأخلاقي والخدمي بالضغط على زر "أوافق".

By using the platform or performing any service through it, you acknowledge that you have read, understood, and fully accepted these terms, as well as the platform rules including attendance, ratings, and ethical and service conduct by clicking "I Agree".

يوافق مقدم الخدمة على احتفاظ المنصة بالبيانات الرقمية والمرئية المدخلة في عملية التسجيل، على أن تولي المنصة الاحتفاظ المشفر بهذه البيانات وسريتها.

The service provider agrees that the platform may retain the digital and visual data submitted during registration, and the platform shall keep such data encrypted and confidential.

تعد هذه الشروط والأحكام اتفاقا قانونيا ملزما يحكم استخدام منصة (Gig)، وهي منصة تقنية رقمية تعمل كسوق إلكتروني يتوسط بين الشركات ومقدمي الخدمات لتنفيذ نوبات (فترات) خدمات خلال مدة قصيرة أو لإنجاز مهمات محددة من قبل الشركة، وتوفير أدوات لإدارة النوبات والتحقق والتقييمات والمدفوعات.

These terms and conditions constitute a binding legal agreement governing use of the (Gig) platform, a digital technology marketplace that intermediates between companies and service providers to execute shift-based services over short periods or to complete company-defined tasks, while providing tools for shift management, verification, ratings, and payments.

يعد استخدام المتصفح للمنصة أو تقديمه كمرشح لإنجاز الخدمة المعروضة قبولا صريحا ونهائيا لكافة الشروط والأحكام الواردة بهذا المستند.

Any use of the platform by a browser user, or submission as a candidate to perform a listed service, constitutes explicit and final acceptance of all terms and conditions in this document.

يلتزم كل من القائمين على المنصة ومقدمي الخدمات من خلالها بكافة القوانين واللوائح التنفيذية والقرارات بقوانين السارية في جمهورية مصر العربية، وأي قاعدة قانونية تنظم توفير مقدم الخدمة للشركة.

Both platform operators and service providers must comply with all laws, executive regulations, and decrees having the force of law in force in the Arab Republic of Egypt, as well as any legal rule governing the provision of services by the service provider to the company.

يقر كل مستخدم ومقدم خدمة عبر المنصة بالامتثال للوائح والسياسات الداخلية المقررة بداخلها وأي أوامر أو قرارات تنظيمية بشأنهم.

Each user and service provider on the platform acknowledges compliance with internal platform policies, regulations, and any organizational orders or decisions applicable to them.

يمكن للشركات عبر لوحة تحكم المنصة إنشاء ونشر نوبات الخدمة المتاحة متضمنة المتطلبات الأساسية مثل الشاغر المتاح ووصفه وتاريخ ومدة النوبة وموقع إنجازها والمهارات والمؤهلات المطلوبة والمقابل المالي وأي تعليمات أو متطلبات خاصة.

Through the platform dashboard, companies may create and publish available service shifts, including core requirements such as vacancy details, description, shift date and duration, location, required skills and qualifications, compensation, and any special instructions or requirements.

يتم إنشاء وعرض النوبات المتاحة بناء على المتطلبات المحددة بجانب كل نوبة من قبل الشركات بعد إرسالها للمنصة، وتصبح مرئية لمقدمي الخدمة المؤهلين، وتتحمل الشركة مسؤولية دقة المتطلبات والبيانات.

Available shifts are created and displayed based on company-defined requirements attached to each shift after submission to the platform; they become visible to qualified service providers, and the company bears responsibility for the accuracy of those requirements and data.

تهدف المتطلبات والبيانات المعروضة إلى تمكين مقدم الخدمة من اتخاذ قراره بشأن التقديم على النوبة على مسؤوليته الشخصية.

The displayed requirements and information are intended to enable the service provider to decide whether to apply for the shift under their own responsibility.

يحق للمنصة رفض عرض أي نوبة يتم إرسالها من قبل الشركات في حال كانت المنصة تحت تحديثات أو أعطال تقنية أو لأي سبب آخر، على أن يتم إخطار الشركة بالرفض مسبقا.

The platform may reject publication of any shift submitted by companies if the platform is under updates, technical issues, or for any other reason, provided the company is notified of the rejection in advance.

لضمان الموثوقية والجودة والثقة داخل المنصة، يقوم مقدم الخدمة بإنشاء حساب مقدم خدمة واستكمال خطوات التسجيل.

To ensure reliability, quality, and trust within the platform, the service provider must create a service-provider account and complete registration steps.

تشمل خطوات التسجيل رفع وتقديم بيانات وصورة تحقق شخصية صادرة عن جهة حكومية، والاسم القانوني الكامل، وتاريخ الميلاد، وبيانات الاتصال، ومحل الإقامة، ونطاق التوفر لتقديم الخدمة، على أن تكون دقيقة وصحيحة.

Registration includes submitting identity verification data and image issued by a government authority, full legal name, date of birth, contact details, residence, and service availability range, all of which must be accurate and valid.

تشمل كذلك بيانات الخبرة والملف التشغيلي والشخصي والخبرات السابقة وسجل المواقع أو الجهات التي قدم لها خدمات سابقا والمهارات وتفضيلات نوع وفئة تقديم الخدمة.

It also includes experience data, operational and personal profile details, prior experience records, locations or entities previously served, skills, and preferred service type/category.

تقبل المنصة تسجيل فيديو مرئي لمقدم الخدمة للتحقق من الهوية والجودة على ألا يقل عن دقيقة، يتضمن التعريف بالنفس ونبذة عن الخلفية أو الخبرة وتأكيد الرغبة في تقديم الخدمات عبر المنصة، ويحتفظ بهذا الفيديو لغرض التحقق من المصداقية والثقة.

The platform may accept a visual video recording from the service provider for identity and quality verification, of at least one minute, introducing themselves, giving a brief background/experience summary, and confirming intent to provide services through the platform; this video is retained for credibility and trust verification.

يحق للمنصة التأكد من بيانات التسجيل مثل صحة الهوية واكتمال البيانات والالتزام بالمعايير، ويحق لها قبول الحساب أو طلب مستندات إضافية أو رفض التسجيل.

The platform has the right to verify registration data such as identity validity, data completeness, and compliance with standards, and may approve the account, request additional documents, or reject registration.

لا يمكن للمتصفح التقديم على أي خدمة عبر المنصة إلا بعد استكمال إجراءات التسجيل.

A browser user cannot apply for any service on the platform before completing registration procedures.

يحق للشركة مراجعة ملفات مقدمي الخدمة وتقييماتهم عبر المنصة والاطلاع على مؤشرات الأداء والتقارير التشغيلية مثل نسبة تغطية النوبات ونسبة عدم الحضور وتقييمات النوبات السابقة وملخصات الاستخدام واستقبال إشعارات المنصة.

Companies may review service-provider profiles and ratings on the platform, and view performance indicators and operational reports such as shift coverage rates, no-show rates, prior shift ratings, usage summaries, and platform notifications.

عند قبول مقدم الخدمة يتم تأكيد النوبة وإخطار مقدم الخدمة عبر المنصة، ويلتزم مقدم الخدمة المقبول بالحضور إلى الموقع الجغرافي أو الإلكتروني المحدد من قبل الشركة في الشاغر المعروض.

When a service provider is accepted, the shift is confirmed and the provider is notified via the platform; the accepted provider is obligated to attend the geographic or online location specified by the company for the listed vacancy.

التقديم على النوبة من قبل صاحب الحساب لا يعني موافقة الشركة تلقائيا على المقدم.

Applying for a shift does not mean automatic company approval of the applicant.

لا يعد تقديم مقدم الخدمة على الشاغر قبولا نهائيا من قبل الشركة، إذ يتم تأكيد الاختيار لإتمام النوبة عبر المنصة، ويلتزم مقدم الخدمة بالحضور وتنفيذ النوبة حسب الاتفاق.

A provider's application to a vacancy is not final company acceptance; selection is confirmed through the platform, and the provider must attend and perform the shift as agreed.

يتم دعم كل شركة بواسطة مدير حساب عبر المنصة يمكن التواصل معه عبر الهاتف أو الرسائل للدعم التشغيلي أو التصعيد أو الإرشاد.

Each company is supported by an account manager through the platform, reachable by phone or messages for operational support, escalation, or guidance.

لا تعد الشركة ولا مدير حسابها صاحب عمل بالنسبة لمقدمي الخدمة ولا وكيلا عنهم.

Neither the company nor its account manager is considered an employer of service providers or their legal representative.

يجب على مقدم الخدمة الحضور في الموعد المحدد من قبل الشركة وتنفيذ مهام النوبة وفقا لمتطلباتها والالتزام بقواعد الشركة.

The service provider must attend at the time set by the company, perform shift tasks according to requirements, and comply with company rules.

بعد انتهاء الحضور تقوم الشركة بتأكيد حضور مقدم الخدمة عبر لوحة التحكم أو المنصة وتسجيل انصرافه، ويقوم مقدم الخدمة بتأكيد وقت الانصراف المرفوع من قبل الشركة لتأكيد اكتمال النوبة وأحقية الدفع.

After attendance ends, the company confirms provider attendance via dashboard/platform and records checkout, and the provider confirms the checkout time submitted by the company to confirm shift completion and payment eligibility.

يحق للشركة عند الحاجة نشر نوبات إضافية واختيار مقدمي الخدمات بناء على أدائهم وتقييماتهم السابقة.

When needed, the company may publish additional shifts and select service providers based on prior performance and ratings.

عدم حضور مقدم الخدمة أو ضعف أدائه قد يؤثر على تقييمه وفرصه في الحصول على نوبات مستقبلية أو حالة حسابه.

A provider's no-show or weak performance may affect their rating, future shift opportunities, or account status.

بعد انتهاء النوبة يحق لكل من الشركة ومقدم الخدمة تقديم تقييم متبادل عبر المنصة لضمان الثقة وجودة الخدمة، على أن يلتزم كل مقيم بمبادئ المصداقية والدقة.

After a shift ends, both company and provider may submit mutual ratings on the platform to ensure trust and service quality, with each reviewer adhering to honesty and accuracy.

تستخدم التقييمات لأغراض تحسين جودة الخدمة وإدارة حسابات المستخدمين.

Ratings are used to improve service quality and manage user accounts.

تتم معالجة المدفوعات وفقا لجدول صرف Gig، وبتنفيذ مقدم الخدمة للنوبة تقوم الشركة بدفع المقابل المالي المتفق عليه والمعروض عبر لوحة التحكم بالإضافة إلى رسوم أو عمولة خدمة Gig خلال 7 يوم، وتعدل سياسات الصرف وفقا للمعروض على المنصة.

Payments are processed according to the Gig payout schedule. Once the provider completes the shift, the company pays the agreed compensation shown on the dashboard, plus Gig service fees/commission within 7 days, and payout policies may be updated according to what is published on the platform.

تتم المدفوعات والمقابل المالي لمنصة Gig وفقا لشروط الدفع المتفق عليها.

Payments and financial consideration for the Gig platform are handled in accordance with the agreed payment terms.

تقوم Gig بتحصيل رسومها ومستحقاتها مباشرة من الشركة عبر الدفع الإلكتروني من خلال لوحة التحكم أو عبر التحويل البنكي المباشر، ويتم دفع المقابل المالي لمقدمي الخدمة بشكل منفصل عن رسوم أو عمولة Gig.

Gig collects its fees and dues directly from the company via online payment through the dashboard or by direct bank transfer, and compensation to service providers is paid separately from Gig fees/commission.

تعد المنصة وسيطا وسوقا مستقلا عن شخص الشركات ومقدمي الخدمات المتعاملين عبرها ولا تضمن أي منهما للآخر، ولا تعتبر صاحب عمل أو وكيلا لمقدمي الخدمات أو للشركات إلا في اتفاقيات منفصلة ومكتوبة.

The platform is an intermediary and an independent marketplace separate from the legal identity of companies and service providers using it, does not guarantee either party to the other, and is not deemed an employer or agent for providers or companies except under separate written agreements.

تخلي المنصة مسؤوليتها عن أي نزاع أو مطالبة تنشأ بين الشركة ومقدم الخدمة نتيجة تنفيذ النوبة.

The platform disclaims liability for any dispute or claim arising between a company and a service provider as a result of shift execution.

يتحمل كل مستخدم المسؤولية الكاملة عن مدخلاته وأفعاله وتصرفاته داخل وخارج المنصة.

Each user bears full responsibility for their inputs, actions, and conduct inside and outside the platform.

تلتزم المنصة بالحفاظ على سرية وخصوصية بيانات المستخدمين، ومعالجتها وفقا لأحكام القوانين المنظمة لحماية البيانات الشخصية في جمهورية مصر العربية، ولا يتم الإفصاح عنها إلا في الحدود التي يجيزها القانون أو بموافقة المستخدم أو مقدم الخدمة.

The platform is committed to preserving confidentiality and privacy of user data and processing it in accordance with personal-data protection laws in the Arab Republic of Egypt, and such data will only be disclosed within legal limits or with the consent of the user/service provider.
